Serving the Greater Salt Lake Area for 40 Years

When most people think of bankruptcy, the idea that comes to mind is closely associated with Chapter 7 bankruptcy. Also referred to as liquidation bankruptcy, non-exempt assets are surrendered and sold to pay off debt. All remaining eligible debt is then discharged.

Although the term “liquidation” can leave some debtors in fear of losing their home, vehicle, or personal property, much of what you own is protected. With Chapter 7 bankruptcy, you will be allowed to keep your clothing, furniture, and most of your personal belongings. You may also be able to retain your financed vehicle or home, provided you can continue to make payments.

When you get into a financial situation where bankruptcy seems like your only option, you need to be educated on current bankruptcy law and how this will affect you. You can do this most effectively by involving an attorney who can give you the information you need to make the right choice for your situation. Our Midvale Chapter 7 bankruptcy lawyers are standing by to help.

What Debt Is Discharged in a Chapter 7 Bankruptcy?

In a Chapter 7 bankruptcy, most of your unsecured debt is discharged (eliminated). This includes:

  • Credit card debt
  • Personal loans
  • Medical expenses
  • Certain judgments
  • Some taxes
  • Other qualifying debt

The following debt cannot be discharged:

  • Child support payments
  • Certain taxes
  • Student loans
  • Certain judgments

Although not all debt can be discharged under Chapter 7, you will be in a better position to pay these non-dischargeable expenses.

When you meet with our Chapter 7 bankruptcy attorneys at our Midvale office, we can find out which types of debt will be discharged and which won’t, so you have an accurate picture of what debt you’ll be left with after bankruptcy. We can also help you figure out if bankruptcy is really the best option for you.

The Means Test

To determine whether you are eligible for Chapter 7 bankruptcy, or if you qualify for Chapter 13 bankruptcy instead, the court requires you to undergo something called a means test. This evaluation takes your income and living expenses into consideration and balances them against your debt level to determine whether you would be able to pay the debt off within a certain period of time.

If the figure that results from the balance is below a certain level, the judge will likely allow you to begin the process of filing a Chapter 7 bankruptcy.
